A Final Judgment Should Not End the Search for Truth
Michael Blair Wellington was convicted of first-degree murder after asserting that he acted in self-defense. His direct appeal is over. What the Official Record Says
Credible advocacy begins by acknowledging the decisions already made. Michael's jury rejected his self-defense claim, and the appellate courts did not reverse his conviction. The present question is whether post-conviction review should address evidence and defense failures that the direct appeal did not resolve.

The Distinction That Matters
The direct appeal examined the trial record and rejected the claims presented there. Post-conviction review can ask a different question: whether constitutionally significant evidence, investigation or expert analysis existed outside that record because trial counsel failed to develop or present it adequately.
The Courtroom Accountability Project's review focuses on the quality and completeness of the defense investigation—not on pretending that the prosecution's evidence or the appellate rulings do not exist.
According to a sworn declaration from the defense investigator assigned to the case, trial attorney Ray Newman did not provide the investigator with the complete discovery and limited the assignment to two interviews. If accurate, that account raises a direct question: what potentially favorable evidence remained undeveloped because the defense investigation was restricted before trial?
Four Questions That Deserve Answers
1. Why Was the Investigation So Narrow?
The defense investigator's declaration describes incomplete access to discovery and an assignment limited to two interviews. A homicide case built around disputed intent and self-defense required a comprehensive investigation.
2. What Would Zondra Flowers Have Added?
Michael's wife, Zondra Flowers, was present during the events leading to the shooting. The current case review says she described an assault against her and saw Jackson produce a firearm, but at trial she invoked the Fifth Amendment on advice of counsel and did not provide substantive testimony.
3. Why Weren't Relevant Experts Presented?
The motion for a new trial relied in part on declarations from a gang expert and a clinical trauma specialist. The Court of Appeal held that Michael had not established ineffective assistance or prejudice. Post-conviction review should test the issue against the complete available evidence.
4. Was the Physical Evidence Fully Developed?
The case review raises questions about firearms evidence, forensic testing and the evidence supporting competing accounts of the confrontation. Those questions should be tied to authenticated records and evaluated rather than reduced to slogans.

Michael's written account asks readers to imagine the case from inside the fear, threats and family conflict he says shaped the confrontation. He maintains that he believed he and his wife were in danger and that the trial failed to present the complete context for his actions.
A fair review does not require anyone to accept Michael's account without scrutiny. It requires the system to test that account against every material witness, record and piece of physical evidence that competent representation should have developed.
